Terms of Service

§ 1. General Information
- These Terms of Service govern the use of the PredictStats platform, available at predictstats.com.
- The platform administrator is PREDICT STATS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (PREDICT STATS Limited Liability Company) with registered office in Świniarsko (33-395) at Świniarsko 134, registered in the National Court Register under KRS number: 0001176159, Tax ID (NIP): 7343656695, REGON: 541866775, with share capital of PLN 5,000.00 (hereinafter: "Administrator" or "PredictStats").
- Contact with the Administrator: contact@predictstats.com.
- Using the PredictStats platform means acceptance of these Terms of Service.
- The Administrator reserves the right to change these Terms. Users will be informed of any changes by email or through a notice on the platform.
- New versions of the Terms take effect from the moment of their publication on the platform.
§ 2. Definitions
- Platform – the PredictStats internet service available at predictstats.com and all its functionalities.
- User – a natural person, legal entity, or organizational unit without legal personality using the Platform.
- Account – an individual User account on the Platform, enabling access to its features.
- Premium Subscription – a paid service providing access to advanced Platform features.
- Content – all information, analyses, statistics, predictions, and materials available on the Platform.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.
§ 3. Scope of Services
- PredictStats offers a platform for analyzing sports statistics, predicting match results, and access to advanced analytical tools.
- The Platform offers two types of access: Free (with limited functionality) and Premium (full access to all features).
- The Administrator does not guarantee uninterrupted operation of the Platform and may temporarily restrict access for maintenance or update purposes.
- Content available on the Platform is informational in nature and does not constitute investment advice or encouragement to place bets.
- The Administrator is not responsible for decisions made by Users based on Content available on the Platform.
- PredictStats is not a bookmaker or gambling operator and does not enable placing bets.
§ 4. Registration and Account Use
- To use the full functionality of the Platform, a User must create an Account.
- Registration requires an email address and a password meeting security requirements.
- Users can also register using a Google account.
- Users are obliged to provide true and current data during registration.
- Users are responsible for maintaining the confidentiality of their login credentials.
- Users are obliged to immediately notify the Administrator of any unauthorized access to their Account.
- One Account may only be used by one person. Sharing an Account with others is prohibited.
- The Administrator reserves the right to suspend or delete an Account in case of violation of these Terms.
§ 5. Premium Subscription
- Premium Subscription provides access to advanced Platform features, including: full access to statistics, predictions, analytical tools, and premium features.
- Fees for Premium Subscription are charged automatically in monthly or annual cycles, depending on the chosen plan.
- Current Premium Subscription pricing is available on the Platform website.
- Payments are processed through external providers: Stripe or Przelewy24.
- The Administrator does not store payment card data - they are processed exclusively by authorized payment providers.
- Users can cancel automatic renewal of Premium Subscription at any time in their Account settings.
- In case of Subscription cancellation, access to Premium features is maintained until the end of the paid billing period.
- Subscription prices may change, and Users will be informed with at least 30 days' notice.
§ 6. Payments and Invoices
- All prices are quoted in PLN or EUR and include VAT.
- After payment is made, the User receives a transaction confirmation to the email address provided during registration.
- VAT invoices are generated automatically and available in the User panel.
- In case of payment problems, Users should contact contact@predictstats.com.
- The Administrator reserves the right to offer promotions and discount codes on its own terms.
§ 7. Refunds and Complaints
- Due to the nature of SaaS (Software as a Service) services and immediate access to digital content, the Administrator does not offer a standard right of withdrawal.
- According to applicable consumer protection laws, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgment that they will lose their right of withdrawal.
- Users consent to immediate commencement of service provision (access to digital content) and acknowledge loss of the right of withdrawal.
- In exceptional cases where the service has not been provided in accordance with these Terms or technical problems prevented use of the Platform, the Administrator may consider individual refund requests.
- Complaints regarding the operation of the Platform or Subscription should be submitted to: contact@predictstats.com.
- The Administrator will review complaints within 14 calendar days of receipt.
- In case of justified complaints, the Administrator will take corrective action or consider a proportional refund.
- The Administrator's decision on complaints is final, subject to the User's right to pursue claims through legal channels.
§ 8. Copyright and Intellectual Property
- All Content available on the Platform, including statistics, analyses, predictions, texts, graphics, logos, and source code, is protected by copyright and is the property of the Administrator or licensed partners.
- Users may not copy, reproduce, modify, distribute, or commercially use Content without written consent from the Administrator.
- Use of Content for personal purposes only is permitted, within fair use as defined by copyright law.
- Using the Platform for automatic data collection (web scraping) or creating competitive services is prohibited.
- Copyright infringement may result in Account blocking and pursuit of claims through legal channels.
§ 9. Prohibitions and Unauthorized Activities
- Using the Platform in a manner contrary to law, good practices, or provisions of these Terms is prohibited.
- Users may not: (a) impersonate other persons; (b) conduct activities that could disrupt Platform operation; (c) attempt to gain unauthorized access to PredictStats systems; (d) use the Platform to distribute spam or harmful content; (e) share their Account with others.
- If unauthorized activities are detected, the Administrator may immediately suspend or delete an Account without right to refund.
- The Administrator reserves the right to report illegal activities to appropriate law enforcement authorities.
§ 10. Liability
- The Administrator makes every effort to ensure that information available on the Platform is reliable and current, but is not responsible for its accuracy or completeness.
- PredictStats is not liable for financial losses incurred by Users as a result of decisions made based on Content available on the Platform.
- The Administrator is not responsible for interruptions in Platform operation caused by force majeure, technical failures, or actions of third parties.
- The Administrator's liability to Users is limited to the amount of fees paid by the User for Subscription in the last 12 months.
- The Administrator is not liable for damages resulting from improper use of the Platform by Users.
- PredictStats does not guarantee that the Platform will operate without errors or that all features will be available without interruption.
§ 11. Personal Data Protection
- The Administrator processes Users' personal data in accordance with GDPR and applicable data protection regulations.
- Detailed information regarding personal data processing can be found in the Privacy Policy available on the Platform website.
- Users have the right to access, rectify, delete, and restrict processing of their data, as well as the right to data portability.
- The Administrator implements appropriate technical and organizational measures to protect personal data.

§ 12. Contract Termination and Account Deletion
- Users may delete their Account at any time through Platform settings or by contacting the Administrator.
- When an Account is deleted, all User data will be permanently deleted, except for data that the Administrator is required to retain under applicable law (e.g., accounting data).
- Paid Premium Subscription is non-refundable in case of voluntary Account deletion by the User.
- The Administrator may terminate the agreement with a User and delete an Account in case of serious violation of these Terms.
- In case of termination by the Administrator due to User fault, paid fees are non-refundable.
§ 13. Final Provisions
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and Consumer Rights Act.
- All disputes arising from the use of the Platform will be resolved by the court having jurisdiction over the Administrator's registered office.
- Consumers have the right to use out-of-court methods for resolving complaints and pursuing claims, including recourse to a permanent consumer arbitration court or use of the ODR platform available at: https://ec.europa.eu/consumers/odr.
- If any provision of these Terms proves invalid, the remaining provisions remain in force.
- These Terms take effect on the date of publication on the Platform.
- These Terms are available free of charge on the Platform website in a format allowing for download, storage, and printing.
